• Service refers to the Website and Homestay Booking Services.

• You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company.
These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service, including booking, cancellations, payments, and stay policies at Nembang Homestay.

By accessing or using the Service, You agree to be bound by these Terms and Conditions.
If You disagree with any part of these Terms, You may not access the Service or book accommodation with us.

You represent that you are over the age of 18. The Company does not permit individuals under 18 to make bookings or use the Service independently.

Your use of the Service is also conditioned on Your acceptance of and compliance with Our Privacy Policy, which explains how we collect, use, and disclose Your personal information.

Booking and Payment Policy

1. Room reservations can be made via our official website, verified travel partners, or directly through WhatsApp/email.
2. To confirm a booking, an advance payment of 30–50% may be required. The balance is payable during check-in.
3. All rates are inclusive of applicable taxes unless stated otherwise.
4. Early check-in or late check-out is subject to availability and may incur additional charges.

Cancellation and Refund Policy

1. Cancellations made 30 days before check-in are eligible for a 50% refund.
2. Cancellations made within 7 days of arrival will be charged 100% of the total booking amount.
3. No-shows or same-day cancellations will be charged 100% of the total stay amount.
4. Refunds (if applicable) will be processed within 7–10 working days via the original payment mode.

Guest Conduct and House Rules

1. Guests are expected to maintain peace, cleanliness, and decorum within the property.
2. Smoking is allowed only in designated outdoor areas.
3. Consumption of illegal substances or misconduct with staff or other guests will lead to immediate cancellation of stay without refund.
4. Visitors of registered guests are allowed only with prior permission from management.
5. Guests will be responsible for any damage to property, furniture, or fixtures caused during their stay.

Links to Other Websites

Our website or WhatsApp links may contain references to third-party websites or services that are not owned or controlled by Nembang Homestay.
We assume no responsibility for the content, privacy policies, or practices of any third-party sites.

Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, if you breach these Terms.
Upon termination, your right to access or use our services will cease immediately.

Limitation of Liability

To the maximum extent permitted by law, Nembang Homestay and its team shall not be liable for any indirect, incidental, or consequential damages (including data loss, personal injury, or emotional distress) arising from:

• the use or inability to use our Service;
• any conduct or content of a third party;
• unauthorized access, use, or alteration of Your transmissions or data.

In any event, the Company’s total liability shall not exceed the amount paid by You for your stay.

“AS IS” and “AS AVAILABLE” Disclaimer

Our Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied.
We make no guarantees that:

• the website or booking process will be uninterrupted or error-free;
• the homestay facilities will meet all personal preferences;
• the Service will always be available, secure, or accurate.

Governing Law

These Terms are governed by the laws of West Bengal, India, excluding conflict of law principles.
Any disputes arising shall be subject to the exclusive jurisdiction of the courts located in Darjeeling, West Bengal.

Dispute Resolution

If You have any concerns or disputes about the Service, please first contact us directly at info@nembanghomestay.com.
We will make every effort to resolve the matter amicably before pursuing legal remedies.

Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full effect.
Failure to enforce any right or provision shall not constitute a waiver of that right or provision.

Changes to These Terms and Conditions

We may update or revise these Terms from time to time.
Material changes will be notified through our website at least 30 days before they take effect.
Your continued use of our Service after such changes constitutes acceptance of the updated Terms.
